1.1 The client agrees to avail the services of VR Pixel under these terms. Client acknowledges the terms and will comply.
2. Quotations & Pricing
2.1 All work is to be quoted individually as per the client’s requirements.
2.2 Quotations will contain any additional charges that VR Pixel estimate will be incurred. Should there be any extra charges during the project, we will notify the designated shoot contact prior to continuing any work.
2.3 Quotations remain valid for 28 days from date sent (by email).
3. Payment Terms and Other Fees
3.1 VR Pixel will request a minimum deposit of 25% of the agreed costs on all work that is over £500 (unless otherwise agreed in writing).
3.2 The client agrees to pay VR Pixel the BACS.
3.3 Final payment shall be completed within 28 days after of the day of the event.
3.4 All virtual tours come with 3 months free of charge hosting unless stated otherwise. The following month 4, the hosting will be charged from £8 per tour per month but can be cancelled at any point in writing from the client. The monthly charges are subject to the size of the building. The monthly charges will be stated on the price quote and final invoice.
3.5 All hosted resources on our servers regarding the virtual tour will have a maximum of 1 year of support from the date of the work. If for any reason over after the standard 1-year period, the code becomes unsupported/outdated or the images/resources are ‘lost’ then VR Pixel accepts no responsibility for this and additional costs will be incurred to rectify the issue.
4.1 The client can cancel the contract 30 days before the event and receive a full refund. If the client cancelled the contract within 30 days, then the initial deposit will not be refunded.
4.2 Cancellations made within 7 working days of the agreed event will be subject to a 20% fee of the total quote amount, the initial deposit will not be refunded.
4.3 Cancellations made within 3 working days of the agreed event date will be subject to a 50% fee of the total quote amount, the initial deposit will not be refunded.
4.4 Cancellations made on the day of the agreed event will be subject to 100% of the total quote amount, the initial deposit will not be refunded.
4.5 Late invoices will incur a fee of 2% every 28 days the account remains unpaid.
4.6. VR Pixel reserve the right to re-poses any material or services that have been associated with the project while an account remains in arrears. Continuing to display work produced by VR Pixel will be in breach of copyright law.
5. Copyright, Reproductions, and Usage
5.1 VR Pixel remain the copyright holders of all work produced; this includes all:
- Photography (including aerial drone photography)
- Virtual tours
- Floor Plans
5.2 VR Pixel has the right to display on its work for portfolio showcase, the standard copyright logo and/or the words ‘Produced by VR Pixel’. It should NOT be used for commercial purposes.
5.3 All work produced by VR Pixel can only be used as agreed during the initial project discussions. If the work produced is used in a way that may be in conflict with VR Pixel’s working ethics or practices or used in a direct competition, we reserve the right as copyright holders to repossess work created.
6.1 It is the responsibility of the client to ensure that the virtual tours are suitable for their own website. VR Pixel will always help the client’s web developers, although the final responsibility is with the client.
6.2 Projects are, on average, completed within 1-3 working days of the event date, providing subsequent information we require has been provided in a timely manner (i.e. logos etc.). More complex virtual tours will vary in completion times and expected completion dates will be outlined in your quote.
7.1 It is the client’s responsibility to ensure the locations are prepared and suitable for the event and to the standard they expect. A VR Pixel photographer will not prepare a location and will shoot the rooms as presented. Any photography that requires a re-shoot due to a lack of preparation will be charged for as per our pricing structure.
7.2 If delays are attributed to a lack of preparation on the client’s side, additional charges will be made on the final invoice at our standard rate of £50 per hour.
7.3 Health & Safety regulations are the responsibility of the client and the site owner. If our photographer feels their safety may be in danger, they have the right to stop all work.
8.1 VR Pixel cannot be held liable for any costs associated with the failure of its performance with regards to the services produced.
8.2 VR Pixel cannot be held responsible or liable for any costs incurred due to a delay in the production of any of our services, as due to the nature of work exact time limits cannot be specified.
8.3 VR Pixel cannot be held liable for any costs associated with the failure of its performance with regards Aerial drone photography pending conditions such as weather, location and working with the Civil Aviation Authority.
8.4 These terms and conditions are subject to constant review; always ensure you have read the latest version prior to any project.
9. Warranty & Performance
9.1 Due to the nature of our services, VR Pixel do not offer any warranty. If you identify any bugs or errors, these must be made clear to us within 28 days of receipt of the goods/service.
9.2 All our tours are produced to be run on Adobe’s Flash platform or using HTML5 technology. Due to the constant changing nature of flash and HTML5, we cannot guarantee that in future updates our tours will perform as when produced. We do however always keep an eye on technological advances and always ensure our tours comply with current releases.
9.3 Flash & HTML5 performance varies on different computer setups. For example, as there are now many different browsers available on the market this may have an effect on the tours performance. This also applies to a machine’s memory, broadband speed and also the type of computer i.e. MAC, laptop, iPhone, Netbook etc. Just like a computer game will perform differently on some computers or not at all if the setup is not right. VR Pixel cannot be held responsible for tours that do not run on some users’ computers.
10. Data Protection (GDPR)
10.1 VR Pixel takes your privacy seriously and will only keep and use your personal information for reasons the law requires or allows.
10.2 To comply with data protection laws we must be sure you understand how we use any information we have about you. We only keep information for as long as necessary.
10.3 The only information items we will hold are as follows:
- Email address
- Contact number
- Record of previous services
10.4 We will not hold records such as date of birth, lifestyle, family information or any other personal details.
10.5. Data protection law gives you certain rights, but not all these rights will be available to you in all situations. Where we are under a legal duty to use data for a particular purpose, you will not have the right to prevent it from being used that way.
These rights mean under certain circumstances:
- you can ask to see the information we hold about you
- you can ask what’s being done with the information we hold about you
- you can ask to have some of the data we hold about you deleted
- you can ask us to review a decision made about you by a computer and ask for a new decision to be made by a person
- you can ask us to stop processing the data we hold about you
- you can ask us to make changes to the data about you that you believe is inaccurate
- in some circumstances, you can ask us to help you to move your information to another organisation
- you can ask us to restrict or limit what we do with your data, for example, if you believe the information, we hold is inaccurate or if you believe the processing is unlawful.
This contract can only be changed or modiﬁed through the written consent of the parties involved.
